Orly Taitz update re: Major Cook’s case

July 19, 2009

Updated list of birth certificate posts

Here is ORLY TAITZ’s press release re: Major Cook’s case.

I was asked to provide an update and explanation in regards to Major Cook’s case. At the hearing the main point that the Judge brought forward, was the fact that since the military caved in and revoked Major Cook’s orders to go to Afghanistan, he will not be deployed from Fort Benning, GA, and Judge Land in GA no longer has jurisdiction over the case. He recommended that I refile in the Federal Court in the Middle district of Florida, where Major Cook resides and where his employer, Simtech, inc is located. The judge recommended that I file a legal action for damages, as the military has applied enormous pressure on the owner of Simtech, Larry Grise , to fire Major Cook in retaliation for him asking a question about the legitimacy of Obama for position of the Commander in Chief.

I am currently redoing the pleadings and I will refile in Florida.

Sincerely
Dr. Orly Taitz, ESQ

Updated list of birth certificate posts

My browser crashed and with it this post. It gets so demoralizing to have to redo these or try the find ones that went missing besides all of the time that’s wasted. So the discussion is gone.

Here’s a 2-minute news bit done by Lou Dobbs on his July 15, 2009 CNN show about the Major Cook case. (If you’re unaware – follow the link above or check thse sidebar for posts.)

As you know, Lou Dobbs is not exactly a friend of barry’s (and vice versa) and is supposed to be an Independent who investigates issues and yet he is completely uninformed about the birth certificate issue. He says “new questions are being raised” and he’s outraged that the COLB is not a birth certificate and that barry refuses to release his actual birth certificate. He evidently believed factcheck when they wrote that the COLB was the birth certificate. I’m not sure if he’s been enlightened to the fact that factcheck is related to barry and in no way reliable. Neither is Snopes – who just changes information on their “factchecking” when convenient – like the hospital barry was allegedly born in. And Fight The Smears.com that was set up specifically to address the birth certificate issue is completely gone – not even in the cache – thanks to barry’s google buddies. Kitty Pilgrim’s little bit (getting to next) on Major Cook was riddled with nonfacts (lies).

When are folks going to realize that the “factcheckers” and “researchers” for these segments (even on FOX) are barrybots and that if they want to discover the actual truth they have to look for themselves?

Video from Crooks and Liars

LOU DOBBS:

Well, new questions are being raised about the president’s eligibility to be president. THE Latest from U.S. army reserve major Stefan Cook who refused deployment to Afghanistan, proclaimed his orders were illegal because President Obama wasn’t born in United States which makes him ineligible to be president and commander in chief. The major’s orders for deployment to Afghanistan were rescinded. An army spokeswoman told us the major volunteered to go to Afghanistan and could rescind his request at any time up to his deployment. This is what the army said.

[On screen statement: Army Spokesman, Lt Col Maria Quon:] Based on the fact that he no longer wished to serve on active duty and at the request of central command his orders were revoked on July 14.

Now the major’s attorney is challenging the legitimacy of the Obama presidency in court. She joins a lawsuit by former presidential candidate Alan Keys who wants documentary proof the president was born in the United States. President Obama was born in Hawaii according to state officials and copies of his certification of birth, factcheck.org, investigating those circumstances prior to the election and they have a copy of what they say is the original birth certificate posted on their website. It is in fact the so-called short form, not the original document. It is really a document saying that the state of Hawaii has the real document in its possession. White House Press Secretary Robert Gibbs in May said Hawaii provided a copy of the birth certificate with the state seal that’s posted on the internet.

Documentary proof need to run by office, by the way, varies from state to state. The Federal Election Commission, you may be surprised to learn, does not require any kind of certification or proof of citizenship in running for president. They leave that to the state. And in the state of Illinois, for example, where President Obama first ran for office, proof of citizenship is not required prior to the state legislature or to run for congress or for the United States senate.

Major Cook’s comments re: dismissal (text/video)

Cook v Good dismissed
Orly Taitz re: Cook dismissal (video)

As expected, Cook v Good was dismissed. The relief Major Cook sought with his TRO was provided by the Army’s decision to rescind his deployment — something Major Cook could request up until he deployed. There was no issue for the judge to rule on – so case dismissed.

The dismissal does not mean the question of barry’s citizenship is frivolous. There was no judgment made on barry’s eligibility. There was no ruling on whether he is indeed a natural born citizen. There was no determination on whether he actually has produced sufficient proof of birth/citizenship.

The case was dismissed because Major Cook did not have standing – without which there is no case – and because he had already gotten the remedy he sought when the Army revoked his deployment orders.

Here is the video from the LEDGER-ENQUIRER of Major Cook and Orly Taitz outside the Courthouse. I can’t embed it for some reason. I’m not positive–but from the questions asked and since they go in and don’t discuss the ruling — I think this is before the hearing. Plus there is another video from after the ruling.

It’s clear how uninformed the male questioner is. He actually asks Major Cook if he shouldn’t just respect his deployment orders no matter who the president is.

It’s hard to blame (some of) the anti-birthers when this is the type of interview and lack of awareness of the issue they repeatedly see and hear. Kitty Pilgrim on her bit started with “the facts” and “the evidence” and got almost everything wrong. How can someone go on camera and risk their own integrity – and act so indignant – when they have no clue what they are talking about? I’ll be getting to her interview next as well as Lou Dobbs little segment.

MALE QUESTIONER: Does the Barack Obama Administration make you change the way you feel about the United States Military?

MAJOR COOK: Not at all. I love the Army. I want to continue to serve in the Army.

If Barack Obama was indeed a citizen would you [unintelligible] to Afghanistan?

In a heartbeat. If we can establish that he is in fact president of the United States, legally, I’m on the airplane the next day over to Afghanistan — if they cut my deployment orders – so I can do my job that I want to do.

How long have you been in the military?

I’ve been in the military 21 years.

What if someone said you signed up for the US Military, and no matter what your president is, you should, you know, respect your, uhm, orders to deploy? What would you say about that no matter who your president was?

That’s irrelevant. What’s relevant is the legality of the order. And if one cannot establish the validity and legality of the order, by the very nature of the oath we serve – the oath we swear and how we serve – we would be following illegal orders and subject to prosecution. If captured, if I am following illegal orders, I could be prosecuted both by the Uniform Code of Military Justice. And if captured, I would not be privy to protections under the Geneva Convention.

What’s the sentiment among your fellow soldiers during this trial that’s coming up?

Thus far, I’ve received quite a bit of popular support from officers in my grade and some officers a grade above and some officers a grade below. So, thus far, I would say 90 percent positive that I’m getting – the traffic I’m seeing.

What kind of precedent do you think this is going to set for future cases such as this? [Such as this??]

This is a critical precedent to set because, with this–there needs to be a mechanism established to accurately and positively identify and verify the validity of someone whose running for such high office as President of the United States.

Video comments after the ruling. Provided by Ledger-Enquirer.com, which is now demanding registration to get in.

FEMALE REPORTER: You knew he was president when you volunteered in May — what happened?

MAJOR COOK: At that time it didn’t occur to me that it would be germane to my deployment. And as the deployment got closer and closer and closer, I was thinking I now will be going into harm’s way and I have to verify, for sure, that the orders I’m following are lawful orders. And that’s at which time I began to question that and…not so much the deployment – butthe legality of the deployment.

I am more than happy, ready, willing and able to deploy and do my duty in Afghanistan as so ordered. But only under lawful orders.

Alot of people have accused you of being a modern day draft dodger trying to get out of deployment? You don’t think that’s the case?

He shouldn’t have dignified her question with an answer but he went on to detail his service, which included combat. He also deployed to Iraq and Afghanistan in Jan/Feb 2009 on a fact finding mission as a contractor.

MAJOR COOK: Whatever capacity, I am happy to serve and do my job, as either an officer in the Army of the United States or as a defense contractor working for the Department of Defense.

And that’s where it gets dicey. It looks like it will neither right now. In the injunction Tait filed (SEE LINK ABOVE), she alleged Major Cook was fired from his civilian job at Simtech, Inc, which is a Department of Defense contractor, because he brought suit. Major Cook had taken a military leave of absence from his job in preparation to deploy and within hours of the Army telling him he didn’t need to deploy, his employer told him he didn’t have a job. I don’t know anything else.

And then the female reporter talks as if Major Cook isn’t standing in front of her.

No one’s doubting his service (please re-read her last question) and his commitment – he says he’ll deploy – that’s not the question.

Taitz answers that the orders have to be legal…and barry’s arrogant…

In terms of if you want to deploy again – what would you need to be see for you to be able to volunteer again?

For me to volunteer to deploy, I need to see that the individual who is sitting the Office of the Presidency – the President of the United States – is legally able to do so. That’s all I need to see.

Note the tense: “need” to see – not “would need” to see.

Cook v Good: Judge Clay’s opinion

July 17, 2009

Here is a copy of the Cook v Good dismissal with the full judge’s opinion. It was dismissed for lack of subject matter jurisdiction, which at its core is lack of standing. The dismissal does not mean barry is eligible or the birthers are wrong. It means simply that the case did not have the technical requirements to be heard. Just like all the other cases.

Plus, the case was already moot. Major Cook arrived in court with the remedy he sought already provided by the Army.

Judge Land’s decision was taken care of by the Army, which may have come from barry himself.

He did take the opportunity to have a mini-rant – though nothing like Judge Robertson’s. And he referred to Orly Taitz as a “him”.

FOX: Major Cook, birth certificate issue (video)

July 17, 2009

FOX broadcast from the 14th. I don’t know who he is – sorry.

America’sNewsToday1

He mentions US Army Major Stephan Cook’s TRO and his refusal to serve because he believes barry is not a natural born citizen and is therefore ineligible to be Commander in Chief.

That his lawyer (who goes unnamed), has a second case challenging the legitimacy of the obama presidency and that a California judge has agreed to hear the merits of it.

That it’s “just one of dozens of legal challenges to the president’s nationality – at least two of them have already been dismissed by the Supreme Court”.

And that the “White House Press Secretary, again, Monday, brushed aside the matter:

ROBERT GIBBS:The noble truth is that the president was born in Hawaii, a state of the United States of America.

So why doesn’t he become noble and tell the truth to the other 56 states?

Taitz goes into barry’s father and the fact that barry was born with dual citizenship.

That he won’t sign a consent to allow Hawaii to release a certified copy of his birth certificate.

Mentions how that COLB is “garbage” and how easily it can be can photoshopped. [True. Watch a demonstation.]

That the court would never accept what’s on the internet.

That he’s provided no passports, immigration or school records.

I can understand her frustration but agitation and calling barry arrogant with his sycophants rolling tape isn’t going to work. The woman who wrote the articles is clearly a barryfan – you can tell from her words and the tone of the piece. I wonder if it’s the same woman that can be heard asking Major Cook questions.

Orly Taitz re: Cook dismissal (video)

Major Stefan Frederick Cook had his day in court today after all. It was the original scheduled hearing and took place despite the fact the Army revoked his deployment order on Tuesday, July 14th. In providing the relief Major Cook sought, the Army took the case right out of the Judge’s hands and covered any doubt regarding their Commander-in-Chief.

With the case moot, it was mere procedure for Judge Clay Land, US District Court Judge for the Middle District of Georgia to dismiss the case.

JUDGE LAND

Federal court only has authority of actual cases and controversies. The entire action is dismissed for lack of subject matter jurisdiction.

And the barry birther haters will say: See – another judge threw out another worthless case!

Yees. Another case dismissed…before it even got started.

That doesn’t mean barry’s been vindicated or Orly Taitz (and the rest of the conspiracist racist birthers) have been proven wrong or that the challenge to barry’s eligibility is not meritorious.

No judge has allowed discovery.

No judge has asked to investigate or have investigated that worthless COLB – which Robert Gibbs officially stated was NOT A BIRTH CERTIFICATE.

No judge has called Dr Fukino to have her clarify her statement – something she volunteered.

No judge has ruled barry is eligible.

No case has gotten that far because no one has standing to compel barry to prove he is eligible.

He has known that from the very beginning.

It’s what he counted on and it’s why he will never voluntarily produce a single document.

And that’s why Quo Warranto exists.

The “actual cases and controversies” and “lack of subject matter jurisdiction” Judge Land speaks of will be taken as the birth certificate issue is not meritorious — instead of the simple fact that the case was made moot by the Army’s revocation.

The question is why?

Because Major Cook volunteered and as such could change his mind and ask for a revocation up to the day of deployment?

Or because they were so ordered by their Commander-in-Chief?

***

There’s no official paperwork on Scribd as yet – but I imagine that Maj Gen Childers and Lt. Col Graef were ruled against for lack of standing.

PLAINTIFF’S VERIFICATION

On this 15th day of July, 2009, the undersigned Plaintiff Major Stefan Frederick Cook appeared in person before me and, having been by me duly administered the oath as required by law, and further having been advised that he made all statements under penalty of perjury, he then and there did depose himself and state that he had read the above-and-foregoing Application for Preliminary Injunction to prevent his deployment to Afghanistan under orders of a chain of command headed by Barack Hussein Obama, and that he had personally verified that all the factual statements contained therein.

As required by Rule 65 the same Plaintiff Major Stefan Frederick Cook also stated that Exhibit A is a true and correct copy of his orders of deployment to active duty, requiring him to report to MacDill Airforce Base in Tampa on July 15 and from thence be transferred to Fort Benning, Georgia, and from thence be deployed in Afghanistan. Exhibits B and C are true and correct copies of the revocation of these orders and e-mail transmittals of the same. Exhibit D is a true and correct copy of the “Army Values” card Plaintiff carries at all times.

Plaintiff affirmed and acknowledged that he conscientiously objected to serving under orders from the armed forces of the United States on active duty if and as currently headed by Barack Hussein Obama, fearing that the President obtained and held his office under false pretenses and fraudulent statements concerning his constitutional eligibility, personal history, and background, and that Plaintiff would be acting in violation of international law by engaging in military actions outside the United States under this President’s command, and that Plaintiff would thus be simultaneously unable to perform his duties in good conscience and yet be simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.

In conclusion, Plaintiff affirmed and verified that he submitted this Application for Preliminary Injunction solely for the purposes and reasons stated, and not for any fear or reluctance to serve his country in the armed forces, but purely and simply from his complete distrust of the Commander-in-Chief and the constitutional qualifications of this de facto President to lead and serve the army, including but not limited to his legitimate authority and power to establish a de jure chain of command.

This verification and acknowledgement was done and executed on this 15th day of July, 2009, in Tampa, Hillsborough County, Florida.
