Andy Martin letter to Gov Lingle re: missing info

Here’s the letter Andy Martin sent to Gov Lingle (R-HI) when he discovered that what he requested was not enclosed in the package she sent. He said he received it in February and sets up this big conference but doesn’t look into the box until the day of the conference?

Dear Governor Lingle:

On November 2, 2008 I transmitted to your office a UIPA demand for “inter-office correspondence among several Hawai’i state offices (the “inter-office” communications), as well as your own internal gubernatorial records (”intra-office” records).

In February I received a package of materials from your office.

I opened the package today, in preparation for a conference in Washington, DC which begins later today.

There were no claims of privilege or other reservations in the box (the UIPA materials were in a box).

The materials, however, were grossly incomplete.

At a minimum, the following were missing:

1. There are no documents reflecting inter-office communications whatsoever from your office or to your office involving the Department of Health and Dr. Fukino. Are we to believe that not a single sheet of paper and not a single message was exchanged between your office and Fukino/Health? It seems totally unbelievable.

2. In my UIPA demand I specifically mentioned the claims of Jerome Corsi and a “sealing” story he had written after receiving a response from your office. Neither Corsi’s communication to your office or your response or any intra-office contacts were included.

3. The package of materials your office sent me was, with a couple of minor exceptions, lacking any of your responses, or intra-office recommendations as to formulating responses to the flood of inquiries about the Obama birth certificate. Who composed the responses, and what memos were exchanged? What were the responses? They are all missing.

4. Finally, there were no inter-office communications between your office and the Hawai’i Attorney General. The Governor is a separate and independent constitutional office and is not under the control of the AG. Thus, you are required to make an independent evaluation of your office’s compliance with the UIPA. Not one piece of paper was delivered to me involving any contact by your office with any other state office, or any other state office’s contact with your office. That is obviously untrue.

5. The Attorney General’s response to my UIPA, and documents which have still not been provided, indicate that the AG is controlling your office’s response to the Department of Health inquiries in my November 2nd letter. Because health is under the Governor, the Governor’s office, not the AG, should control those responses. It is obvious the AG is engaged in a serious cover-up. Why are you playing along when the long-term damage to your own reputation is so clear? I assume the Governor’s office employs counsel precisely so that in contested or disputed matters, the primary of your own office’s authority can be independently established.

Why the cover-up? I made a good-faith request for information concerning someone who was at the time of preparation of the materials you sent me in response to my UIPA the president-elect of the United States. Yet you have almost completely stonewalled my UIPA demand.

Before I file suit, I would like to know why you are hiding these materials, why you did not comply with the UIPA, and when you intend to comply fully and in good faith with my November 2nd request.

I would appreciate it if you both faxed and e-mailed me a response to this letter today, so we may discuss your lack of compliance and any explanation you choose to proffer at the National Conference later today. I certainly want to treat you more fairly than I feel I have been treated by your office.
